The defendants filed a statute of limitations objection in the court proceedings based on the shortened statute of limitations applicable to claims for damages caused to the subject of the lease.
The dispute mainly focused on proving the amount of damage and solving the limitation objection. The court agreed with us that the shortened limitation period does not apply in a situation where the subject of the lease has been destroyed due to the tenant's actions and thus satisfied our client's claim. In total, around 25,000 euros were awarded from the defendants in favor of our client.
