Berthold Vollers GmbH is a Germany-based international logistics company focusing on coffee, cocoa, tea and other valuable commodities across Europe.
TGS Baltic advised Berthold Vollers GmbH regarding a dispute with Cocoanect B.V. and AIG Europe S.A. in the Court of Appeal of the Hague. The case concerns a large-scale (over 2 000 tonnes) theft of cocoa beans from a warehouse in Keila, Estonia. The owner of cocoa, Cocoanect B.V., and insurance company AIG Europe S.A filed a claim against Berthold Vollers GmbH for compensating the value of the goods. TGS Baltic advised Berthold Vollers GmbH on aspects of Estonian law, as well as helped to obtain necessary evidence from criminal proceedings in Estonia.
The case involves a complex set of legal questions from various legal fields – contract law, specific questions of transport law (such as warehouse warrants, distribution of liability etc.), criminal law and data protection. The case also concerned application of Estonian law and general terms of Estonian Logistics & Freight Forwarding Association alongside Dutch law as the main applicable law.
