TGS Baltic represented Forward Tranzit OÜ in a dispute with Stikla Serviss SIA, which focuses on the question of whether the defects found in the glass sold by the client were a manufacturer's defect or were the result of improper transportation or storage of the glass.

The dispute is notable for the extensive and cross-border evidentiary burden - the cause of the defects in the glass has to be proven by a number of different pieces of evidence (including documents and witness statements), and the involvement of an expert in the field of glass defects is necessary.

Stikla Serviss SIA has submitted an expert assessment from Latvia. As there are no experts in Estonia with the relevant accreditation, it was necessary to call upon German and Czech experts to provide an expert opinion.
