TGS Baltic successfully represented bankrupt Ūkio Bankas in a dispute against Renaissance Insignia Limited, a company registered in the island of Jersey, on recovery of funds by way of non-bankruptcy procedures by concluding a financial collateral agreement in accordance with the Financial Collateral Arrangements Law.

The Supreme Court of Lithuania proposed significant expositions on the requirements for financial arrangements to ensure the content thereof and upheld the judgements of the lower courts passed in favour of BAB Ūkio Bankas. This allowed TGS Baltic to achieve that the company registered in Jersey would not be able to circumvent the queue of creditors’ claims to recover a EUR 1.5 million amount.

Since 2013, TGS Baltic has been advising Ūkio Bankas on all legal issues related to the bankruptcy and a wide range of banking and M&A cross-border assignments. Ūkio Bankas, one of the major Lithuanian banks, had its activities suspended and was put under administration due to liquidity problems in February 2013.

TGS Baltic advised insolvency administrator UAB Valnetas on Ūkio Bankas’ bankruptcy matters. Daiva Ušinskaitė – Filonovienė, Partner, and Tomas Bairašauskas, Senior Associate, represented the client’s interests.
