TGS Baltic successfully represented clients in a dispute concerning unfair competition

23.11.2021 TGS Baltic successfully represented clients in a dispute concerning unfair competition

After a court action that lasted for more than a year, the opposing party withdrew their claims filed against the two clients of TGS Baltic. The claim filed against both clients exceeded a quarter of a million euros. Harju County Court dismissed the claims by its order of 15 November 2021. The clients were represented by senior associates Chirag Mody and Silvia Urgas.

The claims were filed against the clients under the Restriction of Unfair Competition and Protection of Business Secrets Act, which, up to the present, has not been implemented often in Estonia. The opposing party claimed that the clients of TGS Baltic have unlawfully, received, used and disclosed business secrets and have, thereby, provided unfair competition to the plaintiff. The dispute was legally complex and included the submission of extensive evidence. After proceedings in county court that lasted for more than a year and the exchange of several positions, the opposing party withdrew the action filed against the two clients of TGS Baltic. Additionally, Harju County Court ordered the plaintiff to cover the procedural expenses incurred by the clients.
