The complex legal dispute concerned the refund of an advance of EUR 80,000 paid to Cryotech Nordic AS under the distribution agreement and an alleged claim of Cryotech Nordic AS for payment of EUR 235,000 for an additional order made by La Campana General Trading LLC. Harju County court agreed with the legal position of TGS Baltic and found that Cryotech Nordic AS must return the advance payment to La Campana General Trading LLC. The county court also agreed that Cryotech Nordic AS was not entitled to charge for the alleged additional orders because La Campana General Trading LLC cancelled the orders in time according to the distribution agreement.
By a decision of 20 January 2021, Harju County Court satisfied the claim of La Campana General Trading LLC in full in the sum of approximately EUR 87,000 and dismissed the counterparty’s counterclaim of EUR 235,000 in full.
