  • About

    Tadas Varapnickas is Senior Associate at TGS Baltic specialising in dispute resolution and international commercial arbitration in particular.

    Tadas holds a Ph.D. in Social Sciences (Law) from Vilnius University (doctoral dissertation: Arbitrator’s civil liability and its boundaries), in 2017 attended an international arbitration course at the International Academy for Arbitration Law in Paris. Tadas is a lecturer at the Vilnius University Faculty of Law, a supervisor of the Legal Clinic of the Vilnius University Faculty of Law, a former adviser to the President of the Republic of Lithuania, Legal Affairs Group.

    Tadas has acquired valuable experience in large and complex projects successfully representing clients in arbitration in accordance with SCC, ICC, and VCCA arbitration rules.

      TGS Baltic team successfully represented leading Italian company in the field of infrastructures, technological systems and services

      TGS Baltic team successfully represented one of the largest infrastructure companies in Italy in arbitration proceedings under the Rules of Arbitration of the Vilnius Court of Commercial Arbitration in a dispute with one of Lithuania’s municipalities regarding the breach of a contract and predetermined damages.

      TGS Baltic's team represented Ūkio Bankas against Deloitte Lietuva and Deloitte Touche Tohmatsu Limited in a claim for of over EUR 100 million for an improperly performed audit.

      TGS Baltic's team successfully defended Bank Snoras

      TGS Baltic together with the prominent Austrian law firm Graf & Pitkowitz Rechtsanwälte successfully defended Bank Snoras before the Vienna International Arbitral Centre (VIAC) in a complex declaratory relief claim sought by another major Austrian bank. Arbitration comprised issues of applicable law, AML regulations, back-to-back loan agreements, requirements for financial institutions and difficult jurisdictional issues. After a two-year legal battle, on 21 January 2019, VIAC arbitral tribunal rendered a decision in favor of Snoras, dismissing the declaratory relief sought by the claimant. TGS Baltic was the leading counsel of the arbitration.

      TGS Baltic team successfully represented one of the largest construction services companies in Lithuania UAB Versina in arbitration proceedings under the Rules of Arbitration of the Vilnius Court of Commercial Arbitration in disputes with the Italian subcontractor Atzwanger S.P.A. regarding additional costs incurred by the latter.

      Infrastructure-related SCC arbitration between the Latvian company AS BMGS and AB Klaipėdos nafta regarding the EPC contract

      AB Klaipėdos nafta was responsible for and successfully implemented the challenging project for the construction of the Liquefied Natural Gas Terminal (LNG Terminal). Due to dependence on the sole source of supply of natural gas and risks associated with it, Lithuania needed to develop infrastructure, which would enable alternative supply of natural gas. The LNG Terminal was the most appropriate type of infrastructure, ensuring the opening of the natural gas market and security of supply of natural gas to Lithuania.

      Assisted in preparing procedural documents for UAB G4S Lietuva, one of the largest foreign capital companies in Lithuania operating in the field of security services to persons and property, in a civil dispute regarding compensation for damages of almost LTL 12 million (EUR 3.5 million) through the subrogation process pursuant to the action brought by insurance companies.

    • Assisted in preparing procedural documents and represented investors in an arbitration case

      Assisted in preparing procedural documents and represented investors in an arbitration case concerning a breach of the shareholders’ agreement and liquidated damages before the Vilnius Court of Commercial Arbitration.

    • Assisted in preparing procedural documents for EURALIS Semences

      Assisted in preparing procedural documents for EURALIS Semences, one of the most important grain producers in Europe, in a civil dispute regarding compensation for damages incurred due to inadequate grain quality.

    • Assisted in preparing procedural documents for the Government of Lithuania

      Assisted in preparing procedural documents for the Government of Lithuania in the international arbitration case against Russia’s gas giant Gazprom before the Arbitration Institute of the Stockholm Chamber of Commerce (SCC) regarding the EUR 1.5 billion overpayments through unfair gas tariffs for gas supplied for Lithuania.

      Represented the President of the Republic of Lithuania in a case for reopening of proceedings on the motion of the judge discharged for the degrading of the name of a judge, for reopening of proceedings upon her acquittal in a criminal.

    • Represented the Office of the President of the Republic of Lithuania

      Represented the Office of the President of the Republic of Lithuania in a civil dispute with the spouse of the late President of the Republic of Lithuania regarding the return of residential premises after the expiry of the loan-for-use agreement.

    • Represented one of the best Lithuanian marathoners

      Represented one of the best Lithuanian marathoners, a participant of the Rio de Janeiro Olympic Games in a civil case regarding compensation for damage caused by illegal use of an image.

    • Representing interests of BAB Ūkio bankas

      Representing interests of BAB Ūkio bankas in litigation for indemnification for damages.

    • Representing a state enterprise in a civil case

      Representing a state enterprise in a civil case against its former manager for indemnification for damages caused by the manager.

    • Representing a Lithuanian company operating in the construction

      Representing a Lithuanian company operating in the construction sector in an administrative dispute with authorities responsible for the protection of cultural heritage about the lawfulness of legal acts adopted by them.
